TERMS OF SERVICE


1. Scope
The general terms and conditions (hereinafter referred to as"GTC") apply to all orders made and contracts concluded (hereinafter referred to as"order") via the Littlies + mums online shop. Littlies + mums reserves the right to change the terms and conditions. The version of the General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order.


2nd offer
The offer is aimed at natural customers with residence resp. legal clients based in Switzerland. Deliveries are only made to addresses in Switzerland. The offer is valid as long as it is visible in the online shop and/or stocks last. Price and assortment changes are possible at any time. The images shown in the online shop and all information about the products are for illustration purposes and are non-binding.


3rd prize
The prices are in Swiss francs. The price in the online shop at the time of the order is decisive. Vouchers or discount codes can no longer be taken into account once the order has been completed.


4. Order
The presentation of the products in the online shop is not a legally binding application, but a non-binding catalog or a non-binding invitation to the customer to order the product in the online shop. An order is considered an offer to Littlies + mums to conclude a contract. After submitting the order, the customer automatically receives a confirmation of receipt that documents that the order has been received by Littlies + mums. Littlies + mums is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded; in particular, the products that cannot be delivered will not be forwarded.


5. Payment Options
Payments must be made in Swiss francs. Credit and debit cards are accepted methods of payment. The available means of payment are displayed in the online shop. The debit takes place immediately.

5.1. Purchase by invoice with partial payment option (POWERPAY)
As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the
order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.
When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice,
you are also agreeing to our GTC, POWERPAY’s GTC. (powerpay.ch/en/agb).


6. Conclusion of contract
A contract is only formed once the order has been processed by Littlies + mums. As soon as the order has been prepared for dispatch, the customer will receive an order confirmation and dispatch notification by e-mail.


7. Delivery
The customer's delivery address must be in Switzerland. Deliveries are not made on weekends and official national or cantonal holidays.
The customer is contractually obliged to accept the service and to check it for completeness immediately after receipt within 3 days. After this period, a complaint can no longer be accepted.
In the event of non-delivery, the customer has the right to withdraw at the earliest four weeks after the agreed date. All estimated delivery times are subject to change without notice. They are only intended as a rough guide and are not binding.
If the customer is not on site at the time of delivery and has not given any specific delivery instructions, the delivery man will leave a collection note in the mailbox. The customer must then pick up the delivery from the relevant post office. Any order that is not picked up within the specified deadlines cannot be kept or refunded. Customers are solely responsible for orders that are picked up late and any warranty rights are excluded. Customers are asked to confirm their pick-up with their signature. Any liability for damage incurred by the customer from loss, theft, misuse etc. in connection with the collection process or the collection ticket is expressly excluded. The customer assumes responsibility for the products delivered, even if they were not received directly by them.


8. Shipping Costs
Delivery costs depend on the quantity of products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the receipt.


9. Warranty
Littlies + mums can provide the warranty either in part or in full with an equivalent product.


10. Returns
The buyer bears the costs for returns. Returns must be agreed in advance with Littlies + mums (info@littlies.ch).


11. Notification of Defects
If products are delivered with obvious damage to the packaging or the contents, the customer must, without prejudice to their defect rights, immediately complain to the delivery man and refuse acceptance. The customer is obliged to have a damage confirmation report issued by the delivery man. All transport damage must also be reported immediately to Littlies + mums. It is also the customer's responsibility to check the ordered products immediately upon receipt. Any defects or deviations from the order must be notified to info@littlies.ch on the day of delivery. Littlies + mums reserves the right to request proof of the defect.


12. Passing of Risk
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of our own, risk passes to the buyer upon notification of readiness for shipment. If Littlies + mums assumes the transport costs as agreed in individual cases, this has no influence on the transfer of risk.


13. Limitation of Liability
Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded, unless intentional or grossly negligent action is involved. Any liability for consequential damage resulting from the use of the products is rejected.


14. Applicable Court and Venue
Untersiggenthal is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
